Asian Business Association of Los Angeles, Inc. a non profit corporation (“ABA”) provides this web site to (i) foster communication and business relationships among our members, (ii) as a means of communication with our members, (iii) to foster business between relationships between selected third parties and our members. This privacy policy is intended to advise you as to what information we gather and how we use it.

Information Collection Policy

ABA collects two types of information:

1. Personal Information

When you sign up as a member, you may be asked to provide personal information. Personal data may also be requested when registering for ABA sponsored programs, events or services. Information including contact information, e-mail addresses, business products or services provided, and member to member discounts are listed on the website to foster the goals of the organization. This information may be shared with selected nonmembers who express a desire to do business with our members. We may also be required to disclose information under applicable laws of legal process or to protect our rights.

2. Website Activity Data

Activity data is gathered through several methods, and is generally tracked as a whole rather than individually. General activity information is gathered to help us to understand the volume of traffic we receive, improve our website and to identify areas of the website which might be improved or changed. ABA reserves the right but has no obligation to track individual activity in order to identify or help prevent abuse, other improper uses, system maintenance or as may be required by applicable law. In order to provide on line event registration or e-commerce activities individual activity may also be tracked.

Cookies and Tracking

Websites often write small data files called “cookies” to your hard drive during your visits to the website. A cookie file is used in order to track your traffic patterns on a particular site and contains information that can anonymously identify you. This information is encrypted for security purposes. ABA may use cookies to help measure the activity at our website or to allow on line event registration or to enable e-commerce to be conducted.

ABA reserves the right to change this privacy policy at any time. When changes are made they will be posted to the website immediately.

Our website may from time to time contain links to third party sites. We do not control the privacy policies, data collection, and terms of conditions of the use of any of these other websites and are not responsible for their activities or your use of these websites. Policy Guidelines for Editorial Content, Third Party Content and External Sources

The goal for editorial content on our website is to be accurate and fair. From time to time we may have articles which discuss legal issues however this content is not intended to serve as legal advice. Users who have specific questions about legal issues should consult with legal counsel. We accept submissions of articles from our members and third parties and we do not conduct a fact check or legal review of these submissions. We rely on the authors to perform all reviews as they deem appropriate and to be responsible for the content and accuracy of their materials. 4. YOUR INFORMATION

4.2 You shall not upload to the website any User Submitted Data which:

(i) Violates or infringes the rights of any persons, including without limitation rights in copyrights, patents, trademarks or other intellectual property rights;

(ii) is libelous, defamatory, obscene, pornographic, abusive or otherwise violates any law; or

(iii) Contains viruses, “worms”, “trojan horses” or any other harmful properties, or use the Services for, or to further, any illegal purposes. The ABA reserves the right, in its sole discretion, to edit or delete any User Submitted Data uploaded to the website in violation of the foregoing.

5. CONFIDENTIALITY

The ABA agrees to protect and maintain the confidentiality of User Submitted Data in accordance with the policies, methods, and procedures set forth in the privacy statements and security policies on the website.

6. TERMINATION

If we believe you have violated these Terms and Conditions, we may terminate your access to the website.

7. INDEMNIFICATION

You agree to indemnify and hold harmless the ABA (and its directors, officers, employees, control persons, suppliers, licensors and agents) from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees and costs) arising out of or related to: (a) your breach of your agreements, representations and warranties contained in these Terms and Conditions; (b) your use of the website (i) in violation of these Terms and Conditions, (ii) in violation of any rights of the ABA or any third-party information provider, including copyright, patent, trade secret, trademark, or other intellectual property rights and publicity and privacy rights, or (iii) in violation of any applicable law, rule or regulation; or (iv) information or materials you upload or post to the website.

8. COMPLIANCE WITH LAWS

You will comply with all applicable laws, rules and regulations in connection with your participation in our programs and use of our website, and will not engage in any act that has an adverse impact on the performance or availability of our programs or our website.

9. GENERAL

9.1 Notices given by the ABA to you will be given by e-mail, or by a general posting on our website, or by conventional mail. In any matter requiring ABA’s prior consent, such consent will be considered given only if made in the foregoing manner by an authorized representative of the ABA. 9.2 Except as herein provided, no waiver, modification or amendment of any provision of these Terms and Conditions shall be effective against the ABA unless the same is in writing and signed by an authorized official of the ABA. The ABA may modify these terms and conditions at any time upon written notice or posting to the website. You agree that if you access and or use the website after notification of changes in these Terms and Conditions, you will be bound by all such changes.

9.4 The ABA’s failure to insist at any time upon strict compliance with any term of these Terms and Conditions, or any delay by the ABA in enforcing these Terms and Conditions, or a continued course of such conduct on the ABA’s part shall at no time operate as a waiver of such power or right, nor shall any single or partial exercise preclude any other future exercise. If any provision of these Terms and Conditions is declared invalid or otherwise unenforceable, the enforceability of the remaining provisions shall be unimpaired, and the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that reflects the original intentions of the parties as nearly as possible in accordance with applicable law. These Terms and Conditions will be governed by and construed and enforced in accordance with the substantive law of the State of California. The parties consent to venue in Los Angeles, California, and to the jurisdiction of competent federal or state courts for all litigation which may be brought with respect to the terms of, and the transactions and relationships contemplated by, these Terms and Conditions.
